It all depends. Are they making him plead guilty to get the deal or is he getting a cwaf? It's probably a 5 year sentence suspended for 7 years. (ie he'd be on probation for 7 years and if he fucks up during those 7 years he has to do the 5). That does seem harsh for a 1st offense but it depends on what was stolen. Legally, since he was the driver and knew what was going on, he might as well have broken in there himself. What does his lawyer say? If he doesn't have one, get one now. In Mass. I've found even public defenders are pretty damn good. There is the occasional stereotypical drunken bum public defender who's totally useless, but that's rare. Most of them are really good and LOVE pissing off prosecutors. |

An old friend who has done numerous years in jail just got arrested for running someone over with his car. Reporting his car stolen after he proceeded to light it on fire in a parking lot, not realizing there were security cameras everywhere. He is looking at 5 years max, with about 18 months to serve. Oh yeah, in case your wondering. You mentioned that someone told the cops and all three were arrested. Well, it had to be one of the three. |
