just got out of the hospital[views:9906][posts:77]_________________________________ [Sep 6,2006 9:45pm - niccolai ""] At work today I got hit by a fork lift. the dude driving is young and shouldn't have been operating it and couldn't quite controll it. My foot got lodged under it it wouldn't move off my foot till one of my boses booked the thing in reverse off my foot. they had to cut my shoe off because of how deformed it was. Before the xray one of my nurses said I might need reconstructive surgery, but after the x ray, to my amazement not a single bone was broken. all the skin and meat looks like mashed potatoes, but none of the bones broke. The doctor though it was nuts too. either way, I'm in the worst pain of my life right now and haveto take like two weeks off work, and I'm part time so I don't get paid for it. I'm hoping my work will realize I can sue them and offer me money. |
_______________________________________________ [Sep 6,2006 9:50pm - mark fucking richards ""] dude, what the fuck?!?! how the hell do you have such terrible luck with injuries?! i thought i was the only one! i'll have to come visit you with some soup and sing you a song after i jump out of a cake. made of ketchup. god almighty. and definitely try getting some compensation. if that kid didn't have a lift license, your employer has no other choice but to pay workman's comp or something equal or greater to that, as well as any hospital bills. |
_________________________________ [Sep 6,2006 9:54pm - powerkok ""] That sux dood. I would assume that your employer will try to do everything to NOT pay you, since you are PT. You may be able to get some comp after a lengthy court case. Shitty situation indeed. |
____________________________ [Sep 6,2006 9:56pm - pam ""] Wow. That's fucking awful. Did they at least give you some good drugs? |
_________________________________ [Sep 6,2006 9:57pm - powerkok ""] Im betting tylenol 3 |

____________________________________________________ [Sep 6,2006 10:32pm - menstrual_sweatpants_disco ""] Jesus, you're not having very good luck with the injuries lately, huh? Get better soon. |
__________________________________ [Sep 6,2006 11:22pm - niccolai ""] Ha thanks everyone. Only the good stuff happens to me. They gave me perks and hygromorphine. I don't take painkillers though, so they will be sold or the perscriptions will get tossed. the kid didn't have a liscense to operate a fork lift, I don't think anyone in the wharehouse does, and also, the forklift doesn't beep when backing up. It didn't hit me when it was backing up, but it just helps show the company isn't really 'up to code' I don't want a lengthy court case, i wish there were a method that involved less headache. I don't really want a huge amount of money, just the pay I'm going to be missing out on and obviously the medicle bills. If they threw me an extra 50 bucks to buy some new shoes sense the hospital had to cut mine to get off of my foot than that would be nice as well. |
________________________________________ [Sep 6,2006 11:29pm - Josh_hates_you ""] If you get hurt on the job they have to pay you. Part time or not. No license = talk to a lawyer with a free consultation. You could walk with an easy settlement. You might lose your job but 50,000 later who cares. |
__________________________________ [Sep 6,2006 11:47pm - powerkok ""] That would be sweet, but it's never that easy. |
________________________________________ [Sep 6,2006 11:58pm - ArrowHead nli ""] Workman's comp. Any warehouse you might be working at carries it. Usually you'll recieve about 40-60% of your usual pay for the duration of your absence. No court cases. Most likely, your work place will volunteer to pay any medical expenditures as well, without any court or lawyers needed. |
__________________________________ [Sep 7,2006 12:00am - powerkok ""] yes....40% of PT work, would = roughly (and Im totally guessing here), 110 bucks a week. That would probably NOT cut it. I dunno, maybe NH and Ma have totally different labor laws. |
__________________________________ [Sep 7,2006 12:05am - Dankill ""] Do what Josh says and own them. Glad to hear you're foot didn't get broken. It sounds like surprisingly it could have been A LOT worse. Hope you heal up soon. Til then, says yes to drugs. |
__________________________________ [Sep 7,2006 12:11am - powerkok ""] The whole reason Im saying youre gonna get effed in the A, is exactly that....the foot ISNT broken, therefore, what are they paying for.... See where this is goin? Ive been through this shit too many times, between myself, family and friends, and the worker ALWAYS gets effed in the A. Even if you get money, its never enough. |

_________________________________ [Sep 7,2006 9:40am - niccolai ""] the bones aren't broken, but there are small partial fractures. You were pretty close to the pay kok, I made about 200 a week but after getting fucked on taxs I only bag about $140 I'm calling a lawyer today. My work offered to pay the medicle bills, but I'm to poor to let that slide right now, I don't even have a pair of shoes since they cut my right one up, so i need some kind of compensation. |

It broke 2 bones and I didn't have a case of the ground beef like you. I honestly think I'd rather have the broken bones!!! If the kid was not certified I say get some money out of them so you can get some new kicks, the car you have been saving for, and a new Engl ;) |

_________________________________ [Sep 7,2006 1:14pm - niccolai ""] PROWORLD said:dude you got hit by a forklift? those things are not that fast? no, they aren't that fast, but you don't really see where the tires are and you usually ssume the people driving them aren't dumb enough to run people over with them. When I looked up the kid was moving it away rom me, than I looked down at my order and he changed direction and hit my foot. |

___________________________________ [Sep 7,2006 1:20pm - anonymous ""] yah the dude driving didn't have a license? you'd win in court hands down. should definately pursue it |
_________________________________ [Sep 7,2006 1:25pm - niccolai ""] My dad talked to a lawyer. Since the dude operating the forklift is an employee of our company, I don't have a court case for some reason (if it were our UPS or sales guy it would be a case) but I am entitled to workmans comp, which is 60% of my paycheck untaxed (which would be about 120 which is close to my taxed paycheck) and if they don't offer me workmans comp, I have a case and am entitled to anywhere between 10-200 grand depending on perminent damage (I'd be happy with a couple thousand) either way, I hope I end up with shoes. this being poor shit is definately not for me. |
__________________________________ [Sep 7,2006 2:01pm - dyingmuse ""] that sucks indeed! you should sue, seriously! you had no workers comp? |

I'll try and get at least a little something. Spalding: I don't know, the way he was explaining it was kindof oer my head, but I'll try consulting a different lawyer. If I get a settlement I'm going to hire Mark Richards to make a comic about my foot. It will be called nothingfoot and will be like idle hands except it will tentacle rape women. Yes we have a UPS guy. Keith, I don't like selling pills to people, If I end up needing money though, I'll be in touch. |
