I was at Newbury Comics and for some reason, instict told me to look at the magazine and I am flipping through and bam, clear as day, a picture of From A Second Story Window that I took from Club Marque: [img] Rev or Carina, how would you handle this? I think I am going to send them an email nicely saying I don't mind them using my pictures, but if they are, I'd appreciate a photo credit or something. Actually, there is another one there from Sick As Sin that I thought was mine, but might actually be one of yours..... |

Which should really be something they start doing because they could get sued easily and without an agreement between the band and their magazine they wouldn't be able to sue the band for fucking them like that. _________________________________________________ [Jul 30,2004 5:15pm - Lynneaustoolazytologin ""] i am very close to this magazine.... i will let you know that the way the mag works is when they are doing a story/review, unless they use a picture that a staff member has taken, they ask the band/label to provide a picture for the story. the band/label is the one who sent the picture to the mag. The mag has no way of knowing if the pic is one that bands friends took/someone from the label/ a freelance photographer. you should email the band and ask why they are using pictures you took without giving you credit. i will however bring this to the attention of the editor of the mag |

What happened was that I had asked for some pics of the band for the story and the label/band sent me over some pics, with no mention of photo credit. I don't mind pointing it out in an upcoming issue (in the editorial) and I do apologize. In the future, should we want to use any live shots, I will ask (as I have in the past) -- again, sorry man.... we put photo credits on all the pics that we are asked to |

I'm thinking it's more about the label sending out the pictures cause I found another uncredited, unasked for picture of myne in one of thier ads. Even if the magazine is using a promo shot from a hired photographer it should be credited and I think magazines should make sure that happens by not accepting photos from bands if the band doesn't give them the credit for it. So instead of e-mailing the band to ask for a photo they should e-mail the band ask for a photo and the name of the photographer and stress the fact that the photographer's name MUST be included with the shot. ultimately it's the magazine's responsibility because they're the ones who'll end up with a lawsuit when they print a photo that has a copyright. And if the magazine tries tries take the band or press guy at the label to court over that, nothing will happen because the magazine never asked the band for the photographers name. you don't see CD's without the engineers name in it. The same should be done with photographers. |

______________________________________________ [Jul 31,2004 7:49am - Lynnetoolazytologin ""] the_reverend said:unrestrained is done by basically 2 guys, they aren't metal manics (though mr. energize bunny rights in mm too) and they won't never had the budget for their on photographers. heck, they are canadian for god sake! yup.... there are two editors... adrian and adam... they started this mag because as they were working on other projects (MEAT magazine and Chronicals of Chaos) they decided they wanted to try it on their own... there are a few staff writers... predominately friends of the two... layout is done by a bud, accounting by a bud, etc...hell when its time to mail out mags...they have a packing party hahah where everyone on staff who can goes to one of the editors house and they stuff mags, write addys out and mail them out this mag has improved sooooo much from the begining... hell the first issue was non glossy black and white. jay i understand your frustration completely...hell ive even had a band send in a pic ive taken to the mag without my name for credit!!! there is soooooo much that goes on behind the scenes of this mag that no one could possibly understand.... and while i understand the "well ask for a pic and name" i really believe the labels/bands should be voluntarily giving this name out... they know damn well that the pic is most likely going to be published.... and they know someone took the pic....and most like who. its very easy for them to say photo by.... or in the case of rev's... they CUT OFF HIS COPYRIGHT... yup the band reduced the pic so the copyright was gone.... soooo yup all i got to say |

Papas Nuclear Blast: SOD photo credit Mark Weiss so out of the five pics i have only two had photocredit and they were both from Nuclear blast... you guys might want to contact labels/bands and let them know you expect credit when your photos are used. |
